Both the American Arbitration Association (“AAA”) and the International Institute for Conflict Prevention and Resolution (“CPR”) have issued new guidance to assist arbitrators and parties engaging in virtual hearings due to the ongoing COVID-19 health crisis.
AAA Guidance includes:
- AAA Virtual Hearing Guide for Arbitrators and Parties
- AAA Virtual Hearing Guide for Arbitrators and Parties Utilizing ZOOM
- AAA Order and Procedures for a Virtual Hearing via Videoconference
According to the CPR, its Model Annotated Procedural Order addresses:
- Selection of Videoconferencing Platform;
- Preparatory Activities;
- Requirements During the Proceeding;
- Documents and Witness Examinations; and
- Enforceability
