Rebecca Green, Professor of the Practice, Co-Director of the Election Law Program, and Assistant Director of the Center for Legal and Court Technology at William & Mary Law School, has published “Arbitrating Ballot Battles?,” Kentucky Law Journal, Vol. 75, 2015-16 (2017). In her research paper, Professor Green explores the potential for using the arbitration process in order to resolve disputes that arise following a state or federal political election.
Here is the abstract:
This short article posits that arbitration is an under-explored mechanism for resolving post-election disputes. Post-election disputes have brought state and federal government to a political precipice numerous times in U.S. history. A comprehensive, transparent, and fair arbitration process could well save us from another.
