Disputing would like to invite you to check out Liz Kramer’s recent blog post entitled “Missouri Declares It Unconscionable For NFL Commissioner to Arbitrate Employment Dispute.” In her blog post, Ms. Kramer examines two significant arbitration decisions that were recently issued by the Supreme Court of Missouri. In one case, the court upheld an agreement to arbitrate an employment dispute despite finding that the National Football League Commissioner was not permitted to serve as the arbitrator. In the other case, the Missouri court “refused to enforce an aspect of an arbitration agreement that it found unconscionable,” and stated “lack of mutuality in an arbitration agreement is not sufficient by itself to make the arbitration agreement unconscionable, but is a factor that courts should consider.” According to Ms. Kramer, the Supreme Court of Missouri demonstrated a “willingness to sever any aspects of an arbitration agreement that it finds unconscionable” while still “enforcing the overall obligation to arbitrate.” You can read more about the decisions and other timely ADR topics at Arbitration Nation.
