New American Arbitration Association (“AAA”) Commercial Arbitration Rules and Mediation Procedures Including Procedures for Large, Complex Commercial Disputes go into effect today. The changes were issued in September and will apply to any arbitration filed on or after October 1, 2013 that is administered by the AAA. The new rules seek to limit discovery costs and burdens, allow an arbitrator to rule on certain dispositive motions, state that concurrent mediation is required unless the parties opt out where a counterclaim exceeds $75,000, and provide an arbitrator with the authority to order emergency measures.
