On Friday, the American Arbitration Association and its international division, the International Centre for Dispute Resolution (“ICDR”), issued a “COVID-19 Update.” The update primarily addressed the AAA-ICDR’s business continuity capabilities, video arbitration technologies, and health and safety measures that are currently being taken by the organization. The AAA-ICDR can assist with alternative hearing arrangements, including offering AAA-ICDR hearing rooms with video capability that will allow remote participation in hearings. The AAA-ICDR has already arranged for and conducted an entire hearing virtually, which is a services that can be provide in other cases provided that sufficient notice is given.
Online video, teleconferencing, internet communication and means other than in-person can facilitate a full and equal opportunity for all parties to present evidence in a hearing. The AAA-ICDR’s hearing rooms and virtual hearing capabilities employ the latest communications technology to ensure parties can present their case as well as any evidence that the arbitrator considers material and relevant to the resolution of the dispute. When hearings involve witnesses, these technologies can allow such witnesses to submit to direct- and cross-examination.
